of Use

miKUADRA does not guarantee or endorse the quality, legality, accuracy, or availability of listed properties. Its role is limited to providing the technology environment for the parties to find and communicate with each other.

These Terms constitute a binding contract between the User and miKUADRA, with full legal effect under Article 4 of the Law on Data Messages and Electronic Signatures (O.G. No. 37,148/2001). They are accepted by:

• Accessing or browsing www.mikuadra.com.
• Creating a user account.
• Checking the acceptance box during registration.
• Publishing a property or using any feature of the Platform.

By registering, the User represents and warrants that:

• They are over 18 years old with full legal capacity under the Venezuelan Civil Code.
• If acting on behalf of a legal entity, they hold sufficient authority to represent it.
• The registration information is truthful, complete, and up to date.
• They are solely responsible for the confidentiality of their credentials.
• They will notify miKUADRA immediately of any unauthorized use of their account.
• They will not share credentials with third parties.
• They will maintain only one active account per individual or legal entity, absent express authorization.

By publishing a property, the Advertiser represents and warrants that:

• They own the property or hold valid, written authorization from the owner.
• The information published is truthful, accurate, and current at the time of publication.
• The photographs are their own or they hold usage rights to publish them.
• The property is not subject to injunctions, liens, pending litigation, or restrictions that would prevent its free disposal, unless expressly stated.
• The stated price is in US dollars (USD), unless expressly stated otherwise.
• They will update or remove the listing within 48 hours of the property no longer being available.

The User agrees not to, directly or indirectly:

• Publish false, misleading, or fraudulent information about properties or identities.
• Use the Platform for activities unlawful under Venezuelan law.
• Attempt unauthorized access to other users' systems or data.
• Send unsolicited communications (spam) through the Platform.
• Use automated tools (bots, scrapers) to extract data without authorization.
• Impersonate other users, agents, or miKUADRA.
• Publish non-existent properties or properties at manifestly distorted prices.
• Use the Platform for money laundering operations or other unlawful financial activities.

miKUADRA offers free and paid plans. Fees are published on www.mikuadra.com and may be changed with 15 calendar days' prior notice.

6.1 Accepted payment methods

• US dollars (USD) via bank transfer.
• International cards via a PCI-DSS certified gateway.
• Stablecoins: USDT (TRC-20) and USDC (see section 7).

6.2 Refund policy

• Premium plan payments are, in principle, non-refundable once the plan is activated.
• In the event of technical failures exclusively attributable to miKUADRA lasting more than 5 consecutive business days, the User may request a credit proportional to the unused period.
• Refund requests to info@mikuadra.com within 7 business days following the event.

• By paying with USDT/USDC, the User represents that the funds come from lawful activities and are not linked to money laundering or terrorist financing.
• Blockchain transactions are irreversible by their technical nature. Once a transaction is confirmed, miKUADRA cannot reverse it under any circumstances.
• The User is responsible for verifying the destination wallet address before executing the transaction.
• Where a refund is due, it will be made in the same cryptocurrency at the exchange rate on the day of the refund, not the original payment.
• miKUADRA may report to the competent authorities transactions that raise reasonable grounds of unlawful activity, in accordance with applicable Venezuelan anti-money-laundering regulations.

8.1 miKUADRA's rights

The Platform www.mikuadra.com, including its brand, logo, the "el Vértice" isotype, design, source code, database, texts and any other element, are the exclusive property of miKUADRA or its licensors. All rights reserved.

8.2 License over User Content

By publishing Content, the User grants miKUADRA a non-exclusive, royalty-free, sublicensable (to technical providers), worldwide license, valid for the duration of the listing, to display, index, and distribute the Content on the Platform and official promotional channels. The User retains ownership of their Content at all times.

8.3 Liability for third-party content

The User shall indemnify miKUADRA for any third-party claim arising from intellectual property infringements committed through Content published by the User.

The Platform is provided "as is" and "as available." miKUADRA does not guarantee: continuous availability, accuracy of listings, successful transactions, users' solvency, or the absence of technical errors. The User assumes full responsibility for independently verifying any relevant information before entering into agreements.

To the maximum extent permitted by Venezuelan law, miKUADRA will not be liable for direct, indirect, incidental, consequential, or punitive damages arising from use of the Platform, including economic losses, the outcome of transactions between users, unauthorized access for reasons not attributable to miKUADRA, or force majeure events.

The User agrees to defend, indemnify, and hold miKUADRA harmless from any claim, damage, cost, or expense (including reasonable attorneys' fees) arising from: (i) Content published by the User; (ii) breach of these Terms; (iii) infringement of third-party rights; (iv) unlawful activity by the User; (v) claims arising from third-party transactions originated on the Platform.

miKUADRA will not be liable for failures caused by unforeseeable and unavoidable events beyond its reasonable control, including: natural disasters, acts of war or terrorism, massive internet infrastructure failures, large-scale cyberattacks, government measures or international sanctions, pandemics, or failures in essential third-party provider services.

13.1 By miKUADRA

miKUADRA may suspend or delete accounts for: violation of these Terms, fraudulent content, risk to the Platform or other users, judicial or administrative requirement, inactivity exceeding 24 months, or failure to pay for more than 15 days.

13.2 By the User

The User may delete their account at any time from the profile settings or via info@mikuadra.com. Deletion entails removal of listings (48 hours), deletion/anonymization of personal data in accordance with the Privacy Policy, and termination of the active plan without a proportional refund except as indicated in section 6.

13.3 Effects

Termination does not affect the clauses that by their nature must survive: limitation of liability, indemnification, intellectual property, and dispute resolution.

In the event of any dispute, the parties agree to attempt an amicable resolution as a mandatory first step. The claiming party will notify info@mikuadra.com in writing detailing the dispute and its claim. The parties will have 20 business days to reach an agreement. Only if no agreement is reached may either party proceed to arbitration.

Disputes not resolved amicably will be submitted to arbitration under the Venezuelan Commercial Arbitration Law (O.G. No. 36,430 of April 7, 1998):

• Seat: Caracas, Bolivarian Republic of Venezuela.
• Language: Spanish.
• Arbitrators: three (3) for disputes exceeding USD 10,000; a sole arbitrator for smaller claims.
• Appointment: one by each party and a third by mutual agreement; failing that, by the Arbitration Center of the Caracas Chamber of Commerce.
• Governing law on the merits: Venezuelan law.
• Award: final, binding, and enforceable under the law.

Exceptions: (i) urgent interim relief prior to arbitration; (ii) claims under USD 200; (iii) actions to collect liquid and due debts.

These Terms are governed by the laws of the Bolivarian Republic of Venezuela, including the Civil Code, the Commercial Code, the Law on Data Messages and Electronic Signatures (O.G. No. 37,148/2001), the Special Law Against Computer Crimes, and other applicable regulations. For users outside Venezuela, the application of these Terms does not exclude the mandatory rights of their country of residence that may apply.

Amendments will be communicated at least 15 calendar days in advance via notice on www.mikuadra.com and email notification. Continued use implies acceptance. Prior versions are available on request at info@mikuadra.com.

If any provision is declared invalid or unenforceable by a competent authority, it will be modified to the minimum extent necessary or removed. The remaining provisions will remain in full force.

These Terms, together with miKUADRA's Privacy Policy and any document incorporated by reference, constitute the entire agreement between the User and miKUADRA regarding the use of www.mikuadra.com, and supersede any prior agreement or understanding on the same subject.

For legal notices, claims, or formal communications:
